Default 3:00am + loud noise = bad morning, Insurance Gurus, Step In!

I was asleep as any normal person would be at 3:00am and I wake up to a loud noise. My wife's 07 Elantra was ran into by a guy that fell asleep at the wheel. My car was forced up the curb and rolled into my yard. I don't know how fast he was going but it totaled his car and they said it did 6100 worth of damage to mine, which to me is totaled, but not to them. The car was about 15 feet up and got moved back. I am going to try my hardest to get this thing totaled out, does anyone have any ideas? If I can't get it totaled, is there some sort of claim I can do to receive some money on the loss of money that I would not receive due to the accident?

Also, how the fuck would a car in PARK fucking roll without breaking the CV axle or transmission itself?

EDIT: BTW, the guy doesn't have insurance if that makes it any better

take a hammer and chisel to the oil pan, punch a hole, bounce it off the rev limiter for a few minutes and tell them the motors blown too...

Police came, tow truck took it, and its at the body shop, which all happened in hours. That's where the estimate came from.

Go talk to the shop. You can always get a second estimate somewhere else too.

Just because you just dropped a lot of money into your car doesn't really have an effect on what it's worth. Obviously there's exceptions, but your car isn't worth $20k just because you've put $25k into it over the years. Same applies to my budget, or what you owe.

It's a weird situation. The car was brought to them and they already took parts off to assess the damage. USAA is sending out someone to look it over

I know someone is an insurance adjuster and can help me out. It's not like I'm asking for a miracle. I've had insurance for over 8 yrs and never had to use it. The one time I need it, I get the damn shaft.

If it doesn't have frame damage your fucked. That car would be so easy of a repair, all you need is a door, fender and a few suspension pieces. Our body shop could probably fix that car for $1000-$2000 paint and everything.

Don't feel alone. The SAME EXACT fucking thing happened to me. The one time I go to use it and I get the big fat fuck you. The adjuster was a complete moron and I wanted to punch his ass in the face. They didn't do shit for me... so fuck all insurance companies until one comes to my aid next time I need them.

Continuously bring up the frame damage with whoever you speak to. If they are already deeming it not a totaled car, the frame damage will be the only thing to lean on that could possibly get them to change their tune.

I don't know if it is considered the frame or not, but the pillar that the door mounts too is mangled and twisted.

I would imagine 6100 is a total for your year car, unless you've put stated value coverage on it. I can't imagine the retail value for your car being clean over 7K since its a 98.
