the spoiler doesn't come up till 140mph or so, but it could have been jolted up from the sudden impact since it is on a small ass actuator.... but as said, I didn't see any pelican flying around anywhere as well... just kinda looks like he tried to see if his million dollar car would float....and yeah, he left it running for aprox 15min while it was in the water..

I think you can manually raise it as well, I've seen pictures of the car sitting still with the spoiler raised.
